1) Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website at https://mytradingaiagent.com and related services (collectively, the “Service”) operated by My Trading AI Agent (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

2) Education-Only; No Financial Advice or Brokerage

• The Service provides educational analytics and explanations about market indicators and related concepts. It does not provide financial, investment, legal, tax, or trading advice, and is not a broker, investment adviser, or fiduciary.
• Outputs and content are general and educational, not tailored to your circumstances and not recommendations to buy, sell, or hold any security or to make any trade or strategy.
• The Service does not facilitate account opening, order routing, execution, or portfolio management and should not be connected to any brokerage, exchange, or automated trading system.

3) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

4) Accounts & Authentication

Certain features require sign-in (e.g., via Google). You are responsible for maintaining the confidentiality of your credentials and for all activity on your account.

5) License; Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial, educational purposes, subject to these Terms.

Prohibited Uses (important)

• Using outputs as financial, investment, or trading advice or as the basis for any transaction.
• Generating or acting on “signals,” “alerts,” “predictions,” or “recommendations.”
• Integrating the Service with any brokerage/exchange, auto-trader, bot, or trade-execution system, or using it to place, time, or size trades.
• Scraping, bulk exporting, or reverse engineering the Service or models.
• Bypassing access controls or using the Service unlawfully or to violate third-party rights.

6) Model Outputs & Data Accuracy

• AI outputs may be incorrect, incomplete, or outdated. Market data and examples may be delayed or illustrative only. You are solely responsible for how you use the content.
• We may label outputs with caveats or limitations; always treat them as educational and verify independently.

7) Third-Party Services & Market Data

The Service may rely on third parties (e.g., authentication, model APIs, analytics, hosting, CDN) and may include or reference market information provided by third parties. Those third parties operate under their own terms and privacy policies, which govern their services and data practices. Availability and accuracy are not guaranteed.

8) Subscriptions, Billing & Cancellation

Paid plans are billed in advance on a recurring basis (monthly unless otherwise stated) via Paddle, our merchant of record. Taxes may be added as required by law. Subscriptions renew automatically until you cancel. You can cancel at any time; cancellation stops future renewals but does not refund charges already processed. You can manage your subscription through your Paddle receipt/manage-subscription link or by contacting privacy@mytradingaiagent.com.

9) Trials & Price Changes

If a trial is offered, you will be charged when the trial ends unless you cancel beforehand. We may change prices prospectively; changes take effect on the next billing cycle, with notice where legally required.

10) Refund Policy

For first-time purchases, you may request a refund within 7 days of the initial charge. Renewal payments are refundable within 7 days of the renewal date if you did not intend to continue. Pro-rated or partial-period refunds are not provided. Refunds are unavailable where the Service was used in violation of these Terms. Where consumer law grants additional rights (e.g., mandatory cooling-off periods), those rights will be honored. To request a refund or cancel, contact privacy@mytradingaiagent.com or use your Paddle manage-subscription link.

11) Intellectual Property

The Service (including UI, code, text, graphics, logos, and content) is owned by My Trading AI Agent or its licensors and protected by law. Except as expressly permitted, you may not copy, modify, adapt, distribute, or create derivative works from the Service or content.

12) DMCA Notice

If you believe content on the Service infringes your copyright, email privacy@mytradingaiagent.com with a DMCA-style notice (your contact info, work claimed infringed, location of the material, a good-faith statement, and a statement under penalty of perjury that you are authorized). We may remove content at our discretion.

13) Sanctions & Export Control

You represent that you are not located in, under the control of, or a national or resident of any country or person on any U.S., U.K., or E.U. sanctions/deny list, and that you will comply with applicable export control and sanctions laws when using the Service.

14) Privacy

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge our Privacy Policy.

15) Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR EDUCATIONAL PURPOSES ONLY, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT). WE DO NOT WARRANT ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY OUTPUT OR DATA.

16) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL My Trading AI Agent OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

17) Indemnification

You agree to indemnify and hold My Trading AI Agent, its affiliates, and personnel harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your misuse of the Service or violation of these Terms.

18) Termination

We may suspend or terminate your access to the Service at any time with or without notice, including if we believe you violated these Terms or applicable law. Upon termination, your right to use the Service ends.

19) Governing Law & Venue

These Terms are governed by the laws of Delaware, U.S.A., without regard to conflicts of law principles. Except as provided in Section 20 (Arbitration), the exclusive venue for disputes will be the state or federal courts located in Wilmington, Delaware, and the parties consent to personal jurisdiction there.

20) Arbitration; Class-Action Waiver (Optional)

Binding Arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. No class or representative actions. You and we may bring claims only in your or our individual capacity. 30-day opt-out: You may opt out of arbitration by emailing privacy@mytradingaiagent.com within 30 days of your first use of the Service with the subject line “Arbitration Opt-Out” and your account email and full name.

21) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
